Welcome to WeHo Loves Locals, an official program of the City of West Hollywood (“City,” “we,” “us,” or “our”). By accessing or participating in programs offered through weholocals.com (the “Site”), you agree to these Terms & Conditions (“Terms”). If you do not agree, please do not use the Site or programs.

1. Program Overview and Acceptance

WeHo Loves Locals promotes local businesses and resident engagement through two core offerings:

• Resident Offers Program – exclusive offers made available by participating businesses;
• Gift Card Program (powered by Yiftee) – digital gift cards redeemable at participating businesses, purchased off-site on Yiftee’s platform.

By using the Site or participating in these programs, you represent that you are at least 18 years old and have the authority to accept these Terms.

2. Resident Offers Program

• Offers are created, managed, and fulfilled directly by participating businesses. Terms, availability, and restrictions for each offer are set by the business and may change without notice.
• The City does not guarantee the availability, pricing, quality, or fitness for a particular purpose of any offer or participating business.
• Redemption issues or disputes related to a specific offer must be resolved directly with the participating business.

3. Gift Card Program (Powered by Yiftee)

• Digital gift card purchases, processing, delivery, balance management, and redemption are provided by Yiftee, a third-party service provider.
• All gift card transactions are governed by Yiftee’s own terms and privacy policy. Please review: Yiftee Terms of Use and Yiftee Privacy Policy.
• The City does not issue cards, process payments, hold card funds, or provide customer service for purchases or balances. For purchase questions, refunds, non-delivery, or balance inquiries, contact Yiftee support via their site.
• Participating merchants may change over time; acceptance of the card is subject to the current list of participating businesses and each merchant’s policies.

4. Eligibility and Acceptable Use

• You agree to use the Site and programs only for lawful purposes and in accordance with these Terms and applicable laws and regulations.
• You will not misuse the Site or programs, interfere with operations, attempt to gain unauthorized access, or engage in fraudulent activity (including abuse of offers or gift cards).

5. Disclaimers; Limitation of Liability

Disclaimers. The Site and programs are provided “as is” and “as available.” To the fullest extent permitted by law, the City disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. The City does not warrant uninterrupted or error-free operation of the Site or programs.

Third Parties. Offers are fulfilled by participating businesses, and gift cards are provided by Yiftee. The City is not responsible for the acts, omissions, or policies of third parties, including offer terms, product/service quality, card acceptance, or platform availability.

Limitation of Liability. To the maximum extent permitted by law, the City will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Site or programs. The City’s total liability for any claim will not exceed the amount you paid to the City in connection with the claim, if any (typically $0, as the City does not sell gift cards).

6. Changes to Programs and Terms

The City may modify, suspend, or discontinue any program or feature at any time without notice. We may also update these Terms from time to time. The “Effective Date” above reflects the latest version. Continued use of the Site or programs after changes means you accept the updated Terms.

7. Intellectual Property

The Site, including logos, program names, graphics, and content, contains material owned by or licensed to the City and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without prior written permission, except as allowed by law.

8. Privacy

Your use of the Site is also governed by our Privacy Policy. For gift card purchases, your information is processed by Yiftee under its own terms and privacy policy.

9. Governing Law; Severability

These Terms are governed by the laws of the State of California without regard to its conflict of laws principles. If any provision is found unenforceable, the remaining provisions will remain in full force and effect.
